The High Court has recently dismissed applications filed by Toh Puan Datuk Patinggi Raghad Kurdi Taib and RHB Investment Bank Berhad, allowing the civil suit initiated by the sons of the late Sarawak Governor, Tun Pehin Sri Abdul Taib Mahmud, to proceed. The plaintiffs, Dato Sri Sulaiman Abdul Rahman Taib and Dato Sri Mahmud Abu Bekir Taib, are contesting the legality of a significant share transfer.
Judge Alexander Siew How Wai ruled that both sons, as beneficiaries, had the right to initiate the suit, and concluded that the case did not qualify to be dismissed summarily. This ruling signifies a notable advancement in their legal challenge.
Details of the Lawsuit
The civil lawsuit centers around the disputed transfer of 50 million shares in Cahya Mata Sarawak Berhad, which were moved from their late mother, Datuk Patinggi Laila Taib, to Raghad. Laila, who was a substantial shareholder with a total of 111 million shares, passed away in 2009.
In a surprising turn of events, 50 million shares were transferred to Raghad in 2023. Sulaiman and Abu Bekir argue that Raghad is not a rightful beneficiary of their late mother’s estate, which leads them to claim that the share transfer was unlawful. They are seeking the restitution of these shares to their mother’s estate.
Next Steps in the Legal Proceedings
The learned Judge has scheduled January 13, 2026, for the next mention date of the case, indicating that the involved parties will move forward to trial.
Sulaiman and Abu Bekir are represented by lawyers Alvin Chong, Jonathan Tay, and Ezekiel John Chong. Meanwhile, Raghad is defended by Alvin Yong and Shirleen Ong, while RHB is represented by Tan Kee Heng and Lesley Ling.
